The Ministry of Maritime Affairs and Fisheries of Indonesia is preparing steps to face anti-dumping accusations in the United States



The Ministry of Maritime Affairs and Fisheries (KKP) has prepared a number of strategic steps to face accusations of antidumping and countervailing duties against Indonesian frozen shrimp exports to the US market from the American Shrimp Processors Association (ASPA) through a petition on October 25 2023.

The scope of shrimp from Indonesia that is subject to the petition includes all frozen tropical shrimp, excluding fresh shrimp and breaded shrimp. "We have prepared to handle AD (antidumping) and CVD (countervailing duties) cases, especially in preparing explanations for policies or programs that are accused of subsidies, especially in the fisheries sector, such as facilitating financing for the fisheries sector, and insurance for small-scale farmers," said Director General of Strengthening the Competitiveness of Maritime and Fisheries Products (PDSPKP) KKP Budi Sulistiyo in Jakarta, Saturday. Currently, the Ministry of Maritime Affairs and Fisheries is focusing on completing the CVD questionnaire as a step to explain the program accused of subsidies with data support, and ensure that the program in the fisheries sector is not discriminatory or not specifically for shrimp. Apart from that, the KKP provides assistance to mandatory respondent exporters in filling out the CVD questionnaire, and has also appointed a lawyer to represent the Indonesian government in resolving the case. He said that the Ministry of Maritime Affairs and Fisheries as the ministry that develops shrimp commodities carefully selected international lawyers to represent the Republic of Indonesia in handling this case. Budi explained that the KKP also accompanies exporters of mandatory AD and CVD respondents together with lawyers appointed by the government and appointed by each exporter in order to fill out questionnaires from the US Department of Commerce (USDOC). Including, it will provide assistance and supervision of the hearing (examination) process and forum for presenting arguments carried out by USDOC and USITC. The KKP, he continued, also submitted an explanation of policies or programs related to the fisheries sector which were accused of subsidies and the results of filling out the CVD questionnaire to the Ministry of Trade as a vocal point on December 22 and December 29 2023. CVD accusations were not only directed at Indonesia, but also Vietnam, Ecuador and India, while AD accusations were directed at Indonesia and Ecuador. Based on Sunset Reviews in 2022, currently there are four countries that are still subject to anti-dumping import duties, namely China at a maximum of 112.81 percent, India 110.9 percent, Thailand 5.34 percent, and Vietnam 25.76 percent.
